| I'm struggling to understand how you can have such categoric views about this case and a better understanding of the issue than the judge despite the fact that you haven't seen all the evidence. It has to be assumed that credible evidence on the medical issue was presented. However, what is likely to happen now is that more claims will be made, some of which may actually be bogus, and the precedent created by this case will mean insurance companies and solicitors will advise the dog owner settle. What the report doesn't deal with is the judge's ruling on Carina Read's claim that cycling was not allowed on the path because it was common land. He or she may have dismissed this altogether or may have ruled it not relevant because the rule hadn't been enforced in living memory. There are a number of leading barristers and solicitors who walk their dog on this green who might be looking into this today. |
