In the case of residents of Glebe estate, the exemption does not apply under either wording. The only difference I could see would be in the very particular circumstance of a premise having two separate access points, one on a restricted route, one unrestricted. The 2002 regulations would imply the access along the restricted route is allowed, even though another access route is possible. If the 2016 regulations created a loophole, then that could be tested in court. However, any extension of the exemption would have to rely on a more logical rationale than allowing access to a destination the other side of the restricted route. |
