David: Do the EU and English law rules you refer to preclude consulting/talking to/informing/responding to questions and other forms of engagement with the public before and during such tendering processes? As I pointed out in a previous post, some formal NHS tendering processes, which I am sure confirm to EU requirements, specifically require consultation with those affects by changes in the provision of services. So formal tendering processes and consultation are not incompatible. The key point is that early consultation can help define the tender spec to which contractors respond. Changing that spec after a contract is signed can be costly and difficult. The fact that the EU processes referred to by the Council don't require such consultation doesn't mean more couldn't have been done through the forms of public engagement I have mentioned earlier in the thread. |
