Without seeing exactly what correspondence passed between you and Hounslow it is difficult to be definitive, but from what you say, Hounslow did NOT make a decision. What they gave you was an INDICATION that were you to apply for such retrospective planning permission it would be unlikely to be refused. But I suspect that that was all it was - an indication which was not binding. As I understand it, whether you apply for planning permission before the fact or retrospectively, the Council goes through the same process of consultation before issuing a decision - so without hearing the objections they can't legally issue a decision - and if they did then it could be overturned on the grounds of non-consultation. You may feel that you were misled by the Council, in which case I suppose you could potentially sue the Council for costs provided that you could prove that you were misled but it appears that you took a risk which didn't work out. |
