I took a detour on my late return home from work tonight to look at the sign. At the time of my visit the west facing display was solely advertising Lucozade and the display wasn't changing. Overall, whilst I personally think the new display looks bloody awful, my professional view remains that no matter what the text of the Inspector's decision says, in the absence of any conditions being imposed relating to the specific nature of the display combined with the fact that planning controls do not cover the specific content (that is a matter for the ASA) of an advertisement, the Council would be skating on thin ice if it took any kind of formal action. And, as I keep saying, whilst I think the new display is visually awful, it isn't helped by the fact it is on a completely out of place part 2/part 3 storey extension that the Council should never (IMHO) have approved in the first place (whilst was approved back in 2004 when I worked at LBH but which I had no involvement in). Incidentally, I can't resist pointing out that if we're all so animated about breaches of planning control, there's a sandwich bar which has continued to trade for the last 6 months not more than 200 metres from the sign, without any planning permission in place whatsoever (and it definitely needs it). Doesn't bother me at all, but I don't see any furore in the media or petitions about it... |
