| You raise an interesting point. If you read Lord Hope's (and his colleagues) the full judgement (R (Jackson) v Attorney General [2005] UKHL 56), you will see that the issue is rather more complicated that the soundbite you have quoted suggests. It deals with the complex issue of sovereignty as a concept as a whole. What Lord Hope was saying was that, for so long as the UK remains bound by the EU Treaties it has signed (with the consent of Parliament) then UK law must be interpreted in accordance with those EU Treaties. We are now getting into a far wider subject of the nature of international law (which, depending upon which school of jurisprudence you adhere to, may, or may not exist, at all). The Parliamentary report on the debate on the EU Bill and Parliamentary Sovereignty deals with the evolving concept of sovereignty. If you can tell me what you mean by sovereignty, then I will give you a straight answer to your question (but that may take up more space then the members of this forum are willing to tolerate). However, if you want a trite answer to your question, then "Yes", we do retain all of our sovereignty. The reason is because what has been done by Parliament can also be undone (as we may be about to see). Although I have argued that we SHOULD NOT leave the EU, I certainly have not argued that we CANNOT leave the EU. We can (under EU law and UK law). Which, in my view, demonstrates beyond any doubt that Parliament remains sovereign. |
