Personally speaking I do rather struggle myself with the notion that the proposal would fail to preserve or enhance the character of the Conservation Area, and if I worked for the Council I would be apprehensive about defending (on appeal) any refusal on such grounds. At the same time just before I left LBH I felt just the same way about one application, and to my amazement the subsequent appeal was dismissed with the Inspector supporting the reason for refusal. Interesting that David Tennant addressed the committee personally, having acted on behalf of famous clients before I tend to keep them well away from such meetings (they usually want to stay away too) as the identity of the applicant isn't a material consideration and at the end of the day no matter how much someone can say "we want to make this our home and live in the area forever" there's nothing in planning that can require them to do so. Which reminds me of one particular client's wife, who, whilst I was 'bigging up' the whole notion of how the family wanted to live in the house for years etc., at the same time had said in a magazine interview how much she enjoyed buying property, living there with the family for afew years whilst doing it up, and then moving !. |
