| Magistrates? When are magistrates ever going to get involved? Someone receives a PCN because they contravened the TMO namely No Motor Vehicles allowed except for access, and the ‘evidence’ provided that the contravention occurred is that the vehicle passed between two points in such a time that no access could have been made. The adjudication should one appeal is made on balance of probabilities I.e. a lower standard than in a criminal case. Average speed cameras are used as evidence to prove a speeding offence has been committed without ever indicating the exact location or time of the speeding offence - using entry and exit times would be similar - to access premises you would need to stop, get out, walk to premises, before getting back into your vehicle and carrying on. If your time from entry to exit suggests an average speed of 15mph or more, it’s reasonable to assume you haven’t in fact accessed premises and have contravened the TMO. If you want to use the route and not get a PCN you are going to have to stop for a while. |
