| The "evidence" that a contravention has occurred doesn't have to be to the same standard as that in a criminal court of law to secure a conviction. If a PCN were to be issued for a contravention and appealed against, the person deciding the outcome of the appeal would make their decision on the balance of probabilities given the evidence and representations made by both parties, rather than to the higher standard of beyond all reasonable doubt. |
