There should be a clause in all leases saying the freeholder will insure the building and recover costs from lessees. It would not ne in the lessees or freeholders interests for each lessee to insure. Who would cover the gf against storm damage to the roof or the top floor against subsidence affecting the foundations etc etc. If you jointly own the freehold if you do not have shares in a management company or equivilent there should be a written agreemnt/deed that you purchase insurance collectively, ie as one policy, sharing costs in proportion. If you do not have such an arrangement, you need to seek legal advice as to how to solve the problem/ and or ask your solicitors when you purchased why the problem was not picked up! |
