I think this case illustrates well how the basis of our law is being slowly but relentlessly reoriented toward the European approach of administrative law and presumption of guilt. Personally I'm not happy with that but of course I have no say in the matter. But note the presumption in the Scotland case of guilt unless you can prove otherwise; the presumption of guilt in money laundering, unless you can prove otherwise; the ability of a US court to extradite a UK citizen without any necessity of producing evidence of a crime and lastly the introduction of the European Arrest Warrant and automatic extradition to countries of less robust legal practice, in effect abolishment of habeas corpus. At a lesser level the courts are being bypassed by the State with justice being handed out by, for example, the Police or indeed the UK Borders Agency. I wonder if a future government will do the right thing when the time comes. I should like to see our ways retained as they protect the citizen from over powerful government. Rant over. |
