| Claire, I don't know for a fact that this is the case. I'm working on the basis that many of these contracts have performance targets written into them. IF Enterprise are responsible for removing fly posters it MAY be the case that their staff are targetting the easy option of ripping down missing pet posters. The Council therefore haven't initiated a policy deliberately but have drawn up the contract ineptly giving Enterprise wiggle room to interpret it this way. By the letter of the law it is the case that missing pet posters breach the rules so the Council simply may have no power to reverse their mistake. Possibly use of the Freedom of Information Act would confirm whether or not this is what has happened but I think Enterprise are not bound by it and the Council may claim details of the contract are 'commercially sensitive'. |
