I am not really sure what Chris is talking about regarding my time scales being wrong but I am very current on housing legislation and the warning of eviction or NOSP gives a tenant 28 days to leave, Pay monies owed in full or seek legal advice. If after 28 days they are still at the property having made no contact or arrangement then they get evicted end of. There is no need for a 48 hour warning they had 28 days. My advice is as soon as you get a notice order seeking possession you go to the local Law Centre or CAB and get advice. Once advice is sought they will notify the court or landlord and if you are applying on a legal matter then you will get another hearing. A landlord has to go to court to seek a NOSP and that is the time to go to court before you get one. I have heard of landlords going to peoples properties to take the court letter so the tenant does not know and is then seen by the court as negligent. All of this should be in a pack a new tenant gets from their landlord including their Assured Short Hold tenancy license they both sign. I have not seen this programme but I will give it a look today and see what everyone is talking about. |
