I see that logic David, but it's not actually correct. Vehicles travel around all the time with branding/advertisements on them, and at other times they are stationary/parked. Same with Mobikes and such like. In this case the business operators themselves fully acknowledge that the bike is placed in that location and left there all day for the purposes of directing attention to a nearby business. So that's the primary function of the bike, not as a mode of transport. It's the same as the trailers you often see parked up in fields along motorways, which Councils end up taking action again on the same basis. The advert regulations are crystal clear that if the primary purpose of a vehicle is for the purposes of advertisements rather than for movement, then it does require consent from the Council. What I would say is that the interpretation section of the regulations doesn't clarify whether a "vehicle" includes a bicycle !. |
