As a result of the Deregulation Act 2015, the Secretary of State for Transport has issued amended regulations which say that a PCN for a parking contravention must be served by a CEO who fixes it to the vehicle or hands it to the driver, or at least attempts to do that. These took effect in April 2015. Use of CCTV for parking enforcement is not actually banned, but generally it can only be used as secondary evidence to support the enforcement by a CEO on the spot. There are exceptions such as stopping at bus stops, bus lanes, school zigzags, etc. where CCTV alone is still allowed, as it is for moving traffic contraventions such as yellow box junctions. Neither Hounslow nor Ealing seem to have updated their web pages on CCTV enforcement. For example, Hounslow still says that it uses mobile CCTV vans to enforce parking regulations in CPZs, though that is not now allowed. In another change to the regulations which also took effect in April 2015, where a vehicle has been allowed to park for a limited period (e.g. free or paid or time-limited permit), and that period has expired, a PCN cannot be issued until 10 minutes after the expiry time. |
