| It most certainly is an EU matter, and is the subject of EU-wide concern – see http://www.bbc.co.uk/news/business-29572475. The TTIP is intended to remove non-tariff barriers to trade, including excessive regulation and red tape – ostensibly laudable aims. The sinister aspect of it is that it allows corporations to resort to tribunals over any measure that might damage future profits. This could impact seriously on legislation for the protection of the consumer or the environment, and might restrict the ability of governments to reverse failed privatisations or decommission nuclear power plants. If there is doubt about where this might lead, one has only to look at the 127 tribunal cases brought by US companies under similar treaty arrangements over the past decade. One of the most egregious was brought by Philip Morris, under the Hong Kong-Australia Bilateral Investment Treaty. Philip Morris, as a US corporation, had no right to make use of the arbitration provisions of this treaty, so they made an investment in Hong Kong, and then brought a case under the treaty arbitration provisions arguing that Australia’s tobacco plain packaging measure was discriminatory and claiming compensation from the Australian government. Those who see the EU as a threat to the sovereignty of the UK should be no less concerned about this proposed treaty. Should we allow US corporations to dictate the policy of European governments? |
