But it's reasonable for Cheryl to use the fact that she did pay as grounds for the council using their discretion. Whether the council decides to use that discretion is up to them, but they are bound to consider the matter fairly. That's why the words they used are important. The fact that they referred to previous goodwill cancellations that Cheryl can't recall is suspicious too. By the way, Cheryl, what stage are you at in the appeals process? Was the latest rejection related to an appeal against a Notice to Owner or against the original PCN? |
