"Under German law defendants can in certain circumstances "buy" termination of a trial.

The legal proviso exists in order to ease the burden on the courts and to deal with cases where reaching a judgment could prove difficult."

Fraud cases are notoriously complex, long winded and hard to prove, so leaving aside for a second the moral dimension of being able to buy justice (and to be honest t'was ever thus, we may not have an equivalent under English law, but if you're rich you can definitely afford superior lawyers). Then you can see the attraction from both sides, Bernie, at 83, now doesn't have to spend the next X years in court, and the German authorities have a decent amount of wedge to spend on whatever and a senior judge is now no longer tied up for god knows how long with an uncertain outcome.
