| Neil, I don't know all the details of your case ... however you should be aware that if you have been made an offer of damages/compensation and you choose not to accept it, even if the outcome of the case is in your favour, if the amount you are awarded is the same or less than you were offered, you may find yourself liable for all the defendant's costs that arose after the offer was made. I've been in this situation myself, and we continued with our claim, and everything was settled out of court, but ... you should be aware of the risk that if you are awarded less than you have been offered to settle the case early, it will cost you a lot more than £400. |
