Still wrong. You could perhaps say that when the estate was developed more could have been done to protect right of way but all those around at the time have long gone. Everyone assumed right of way was established but even had the council anticipated the threat the best course of action was to let open access continue as long as possible without bringing things to a head on the basis that the more established access was, the more likely right of way was to be accepted. However, the court ruled it was private land and, unless you were aware of some legal basis for stopping this that didn't occur to the council's lawyers and all the people who were opposed to this, that result was inevitable. |
