It would almost definitely be a limited company. If the small claims court rule in his favour and the restaurant don't pay him they will get a CCJ against them which will mean that their credit rating will take a hit (both company and the personal rating of the directors). They will also find it much more difficult to get supplier credit to the extent that it would be almost impossible to run a restaurant profitably. You don't need a solicitor to make a claim. If the waiter doesn't have English as a first language then help from a reasonably well educated native speaker should be enough to get him through the process. He must of course have some documentary evidence - if he doesn't he will struggle to get anything.
