It's impossible just to redesignate a business as this crook appears to be trying to do. Either the former restaurant has gone into liquidation in which case the waiter would have to enter a claim with the liquidator - he would have a reasonable chance of getting something as he would be first in the queue behind HMRC. Or the business has been sold to a third party - unless otherwise stated in the contract all assets AND liabilities would transferred to the new owner including unpaid wage bills. If the business has been sold and such liabilities haven't been disclosed that is fraud and possibly a police matter. Small claims is a good place to start. There is no chance of not winning if the claimant has a good paper trail of evidence proving that he is owed the money. |
