LBH have a duty to refund the charge to the person who paid it. They do not know who paid each PCN. They cannot assume that the person who paid is the registered keeper of the vehicle. Details of the card used for payment would have been discarded after the payment was made in order to comply with the DPA. Some of these PCNs date from May 2013. It's possible that DVLA will not release keeper details to LBH for a vehicle where a PCN was issued to the vehicle over two years ago and the PCN was paid/settled. LBH cannot use other databases like parking permit data for this purpose, in order to comply with the DPA. Even if LBH were to obtain keeper details, there is no obligation for the keeper to provide the name of the person who paid the charge and no way for LBH to verify that such information provided by the keeper is correct. That's why LBH are asking for proof of PCN payment before making a refund. |
