I have just received an email from the ICO reiterating what Derek Hill was told. What they said was: "You ask for information within the DPA that specifically relate to the stance taken by the council and ask if they are correct in this instance. Initially there is nothing within the DPA which will specifically address this. The DPA is broad and gives eight good handling principles that the council have to comply with. Based on the information you have provided I am unsure why the council are quoting the DPA as it is not a DPA issue as it would neither prevent them from, nor compel them to, contact the individuals and as such is not a matter that we would be able to comment further on". In other words the LBH is talking rubbish, hoping that everyone believes that their hands are tied, and they have done their best, but are prevented from contacting anyone because of the Data Protection Act. Perhaps Cllr Sam Hearn could further pursue the matter? |
