Adrian's post regarding anyone being able to apply for planning permission regardless of whether they have any legal interest in the land concerned is correct, as long as theapplicants serve notice on all parties with a legal interest in the land at the time of submitting the application. Essentially land ownership issues are not material planning considerations. I managed to track down the appeal decision notice yesterday and in boxing terms you could say the Council suffered a knockout in the early rounds as the Inspector very much concurs with the appellants on every point. No offence meant, and it is easily to say this when you have no personal involvement, but given the comprehensive defeat suffered by the Council/objectors I am surprised the residents aren't adopting a more conciliatory tone towards the applicants. As of yesterday the related costs application couldn't be found, it wasn't on LBH's website nor on the Inspectorate website, but reading between the lines of the appeal decision I believe the costs application was successful in respect of the Council's inability to defend (in terms of having evidence ) its claim that the development would harm the living conditions of existing occupiers. But I'll only be able to clarify once I've found the costs application decision. |
