Gervase will be able to quote data more fully I am sure given his knowledge of this area but the challenging of wills is on the increase and has been for several years now. In the event of a reasonable sum being left in an estate to justify the legal action, then the challenge of wills without any law change, will one suspect continue. One of the key drivers from what I have seen is that many children/grandchildren or close relatives do not have the savings needed to see them through life easily and tis is one of the key opportunities of increasing their personal wealth outside of winning the lottery! It should also be appreciated that these cases can go the other way and correct a major wrong. There was a recently reported case of a son who had worked for years on a family farm for a pittance in earnings on the basis his father would leave it to him alone in his will. This he did not do, instead leaving it to be split among the family, all of whom apart from this son wanting to cash out by selling. The Courts in that cases rectified the position and awarded in favour of the son. What it does underline is that your will (and any later changes if you are removing or reducing an inheritance to a family member), needs to have good legal advice and the considering of additional documentation to justify and support your actions to the Courts in the event of any challenge after your death. |
