As to Maggie's original posting about the sales term condition laid down by the seller, I buy some specialist kit second hand though an online forum. That seller has a standard policy (since they do not pack the goods or ship but are simply middle men) that you should examine the packing and ensure not ripped or looks as though opened plus the contents do not sound as badly packed, on receipt. If you are unhappy you are requested not to sign for the goods. They obviously do not expect you to open and test the goods before signing from the guidance given. I have always assumed that with second hand goods the more general statutory rights rules advised earlier in the postings do not apply which indirectly is why use of Paypal to pay for purchases with the right to refund is so attractive for eBay and other similar purchases? |
