Presumably he is going to become a cross-bencher. As he was not elected to the position, he has every right to do so. Unlike the two (now one) UKIP MPs who resigned and fought by-elections when they changed parties, there was a long tradition in the House of Commons that an MP, whichever label he (or she) was elected under, was entitled to remain an MP even after changing their party allegiance. The most famous example was Winston Churchill, who crossed from Conservative to Liberal in 1904 and back again in 1924.
