As I mentioned earlier, planning permission isn't required to demolish a building. What the owners failed to do was to give the Council the required 21 day notice of its intention to demolish the pub (unlike the P&T scenario where the relevant procedure was followed correctly). The application to demolish the pub and replace with flats was actually recommended for approval by Officers, but that was overturned by Members. Whilst in no way condoning a breach of planning control (indeed my professional code of conduct would prevent me doing so), and certainly not one of this seriousness, clearly nothing is going to happen until the appeal against the refusal of the application has been heard. The cynic/ex local government officer in me suspects that essentially the Council's enforcement action is little more than a PR exercise to keep the locals happy, as that action has resulted in an appeal being lodged, and if that appeal is allowed then the Council can point the finger at the independent Planning Inspector. As for any suggestion of the Council carrying out the remedial works itself and recovering costs from the owners, I'm sorry but such suggestions display a complete lack of awareness of the reality of Council budgets. |
