As to whether an injured passenger could claim in the event that a driver is uninsured (whether because they have no insurance at all, or their policy doesn't provide appropriate cover), the MIB (Motor Insurer's Bureau) is required through an agreement with the Government to compensate passengers and other third parties (e.g. pedestrians) in these cases. The MIB is the industry body for UK motor insurers and is funded by them (i.e. effectively from a slice of all motor insurance premiums). http://www.mib.org.uk/Customer+Services/en/Accidents+in+the+UK/Uninsured+Drivers+Agreement/Default.htm According to the agreement, a passenger of an uninsured driver can claim unless they "knew or could be taken to have known that the vehicle was being used without insurance". I doubt someone using Uber could be expected to know that the driver is uninsured, so I would fully expect MIB to pay out (and then seek to recover it from the driver and/or Uber). |
