Well I may be wrong (as sitting on the side of the fence I do I don't have to worry about the statutory consultation process for Councils), but as far as I'm aware Article 13 (relating to publicity of applications) of the 2010 Development Management Order 2010 hasn't been changed, and that Article expressly states that certain applications (those which are a departure from the development plan and certain others) must be advertised both by way of a site notice and "by publication of the notice in a newspaper circulating in the locality in which the land to which the application relates is situated.". So in the case of such applications just placing a notice on the Council website and displaying a site notice wouldn't, as far as I'm aware, satisfy the relevant legislative requirements/provisions (regardless of whether or not anyone reads the Gazette or not). One successful judicial review is going to cost the Council considerably more than a £30k saving !. |
