The first-stage informal challenge is certainly being handled by SERCO. Paul said "if [SERCO] are rejecting appeals for tickets that previously have been ruled to be invalid would there not be a argument that this is fraud?" Not really. Adjudicator decisions apply to the particular circumstances of each case, and in some cases an appeal is allowed (won by the driver) because the council fail to supply enough evidence. Also, an adjudicator decision is not a firm legal precedent in the way that high court decisions are. |
