Whatever the rights or wrongs of the decisions, let's just clarify some points : 1) This application was submitted back in August 2014. As a major application, the Council's target time for determination (set nationally) is 13 weeks. It's entirely 'normal' however for a major application to take almost 6 months to be determined. 2) The emerging Local Plan isn't going to be adopted overnight. The Examination in Public starts on 10th February and is timetabled to last until late March. After that it'll almost certainly be at least 6 weeks before the Examiner announces whether the plan is 'sound' and can be adopted. Hence the current status of the local plan isn't any stronger or weaker now than it is going to be in the next three months, and nor has that status has changed for several months now. So any suspicion about the timing of the decision is ridiculous and shows an ignorance of the mechanics of the planning system. 3) The 'Examiner' referred to in Elizabeth's opening post is presumably a reference to the Inspector who will chair the Examination in Public ? - that Inspector will have no involvement in any JR or anything else relating to this specific application. 4) Sainsbury's cannot 'appeal' as there is no third party right of appeal. The only option is a seek a judicial review of the resolution to approve, on the basis that in reaching that resolution either something was taken into consideration that shouldn't have been, or vice versa. Any subjective opinions about the respective merits of an application cannot be the subject of a judicial review - a JR isn't about the specific outcome, it is more about the process followed. Before anyone starts, I don't want to concrete over Chiswick etc., just merely stating the facts to aid a better quality of debate/discussion. |
