I'm not a lawyer so wouldn't like to say. The Highway Code is not itself law but where there is use of the term MUST, this does refer to law. The only MUST is "you MUST give way when a pedestrian has moved onto a crossing" It also isn't clear if the driver has stayed at the scene or has driven off. |
