Whilst the pedestrian was reckless, if I had to apportion blame I would be asking myself in all the circumstances was the driver driving too fast as they approached the crossing and could/should they have seen the pedestrian. I would say that in this case the driver should have approached the crossing with greater care and would probably apportion blame 75% to the pedestrian and 25% to the motorist. |
