| If the dog had caused an accident on the road, it would be the handler and the owner (if different) who could be prosecuted. They could try to counter-sue the Council if the fence is damaged but it is basically their responsibility to have the dog under control as far as the law is concerned. I would be surprised if any attempt to sue the council would be successful if the damage to the fence is obvious as they might rightly suggest that the handler/owner should not have the dog off lead if they feel that the dog might get through the breach. Of course, none of this takes into account the fact that no dog is 100% reliable as far as recall is concerned and can be startled into bolting or that the state of the common is not satisfactory. The owners who frequently break the law by allowing their dogs to walk off lead on the road (the law specifies a "designated road", but vehicles are no so discriminating) or do not secure their dog in a vehicle enabling it to get loose onto a road could also be subject to prosecution in the event of an accident. Re Jasper - I will mention it again at Hammersmith Dog Club tonight as many of the attendees frequent the areas where he was last seen. I presume that the owners have registered the loss with the various lost dog organisations and their own microchip company? There do not seem to be many posters around. |
