The planning consent to erect the gate was won on appeal to the Planning Inspectorate in August 2011. Hounslow Council (and the then Chiswick Area Committee) had refused the original application. The inspector said in his decision that; "in my judgement the proposed gates and the retention of access to Burlington Lane would not materially affect the number of trips generated by the residents of Chiswick Place and the mode of travel to and from the development, including walking. The appellant’s evidence identifies that there are no public rights of access through Chiswick Place between Burlington Lane and Staveley Road. Although a significant number of local residents claim that the original development proposals should have provided for access, the evidence I possess indicates there is no condition or obligation attached to the planning permission securing public access through Chiswick Place. I have noted the claims of the Council and local residents that the public have used the footway for a number of years and a right of way may have been established. However, this is not a matter for me to determine as part of this appeal. Other than for residents, the appeal scheme would prevent pedestrian access through Chiswick Place from Burlington Lane, especially between the station and Chiswick House. However, the signpost for the pedestrian route from the railway station to Chiswick House directs people along Park Road rather than through the development. Although longer routes, there would remain safe pedestrian access along segregated and lit footways for either rail passengers and the occupiers of residential properties fronting Burlington Lane to Chiswick House or the occupiers of dwellings fronting Staveley Road to the station. Based on my site visit, the additional time to walk the alternative routes is not significant and would not discourage people from walking." |
