I don’t want to bring the party down but.......when Cllr Phil Andrews presented a petition of some 1350 signatures to Thames Water’s CEO, following the Mogden Storm Tank debacle, it was graciously received but no doubt also graciously trashed, because, a year later when nothing had been done, a further meeting was held with Thames Water’s ‘Environment Director’ who said in no uncertain terms “if you don’t like what we are doing, take us to Court and see how far you get” ...... So, residents did just that! In the High Court of Justice transcripts DODSON V THAMES WATER UTILITIES LTD., this outburst is referred to as the ‘watershed moment’ . The result was phenomenal as Thames Water was found guilty on 18 counts of negligence and mismanagement. In an associated case LB Hounslow V Thames Water, Judge Stephen Day ruled that Thames Water’s treatment sites are deemed to be ‘premises’ under EPA 1990 and it is unlawful for Thames Water to permit odour to escape its ‘premises’. Councillors can and should therefore instruct the Director of Environment to issue an Abatement Notice on Thames Water as is his statutory duty under EPA 1990. Unlawful odour is deemed to be Gerome metre readings of above 0.015ppm H2S for 30 minutes or more. Environmental Officers should take these readings off-site to demonstrate the levels of odour being suffered by residents. You won’t get anywhere by discussing and negotiating with Thames Water. Such behaviour is not within the culture of the company. It is very good at glossy presentations, friendly smiles and ‘promises’ of action but the Company will not spend shareholders money of its own volition to deal with odour. They will fob you off for as long as possible and it seems to me this problem has now been going on for months with no resolve. Your Councillors need to take action now! |
