My son recently received a letter from bailiffs wanting in excess of £500 for him having strayed into a box junction and being unable to legally exit. This alleged offence was back in December. OK, he was dim. In November he had moved. Ealing council claims to have sent him a PCN for £80 but since (probably) they sent it to his old address (he didn't notify the DVLA of change of address until December) he didn't receive it. Nor did he receive the summons to the County(?) Court. A couple of weeks back, however, he got this letter from the Bailiffs for the PCN amount (plus, of course, costs). He phoned Ealing Council and told them he had receieved nothing but the bailiff's letter. He said he was quite willing to pay the original amount but, since he had received no notification of the original PCN he didn't see why he should pay the extras. They have told him they cannot rescind the bailiff notification and that he has to contact Northampton (sic) Couny Court. This all seems somewhat overdone to me. (After all, they can find the new address when it comes to a sizeable sum of money). Can anyone (Richard Jennings?) outline the correct procedure to get this stuff corrected more easily? Or are Ealing Council following the correct procedure? Many thanks in advance. |
