Correct, but as you say the Council has only got 28 days from date of receipt of the Part 31 application to decide whether or not prior approval is even required, and if it fails to do so then the applicant is entirely within their right to demolish the building (in accordance with the details submitted with the original application) on the 29th day. In my case 28 days passed without the LPA making any kind of determination as to whether or not prior approval was required, so my client had every right to demolish the building on the 29th day after submission - hence why 28 days is really the key time period. Also better to not confuse the issue by erroneously referring to the granting of planning permission, as even if a Council rules that prior approval is required that isn't the same as planning permission (sorry to be pedantic). |
