As from 30 May 2013 and for a period of three years (between 30 May 2013 and 30 May 2016) a change in the law will allow some house owners to build larger single-storey rear extensions – up to 8 metres deep for detached houses, and 6 metres deep for all other houses.

If you want to build such an extension (i.e. if it extends between 4 and 8 metres for a detached house, or between 3 and 6 metres for any other house), you must first write to the council telling us you want to do this and provide some information.  Before you are allowed to go ahead, your proposal must go through a neighbour consultation scheme.  Your neighbours then have a right to object.  As a result of this consultation, we may sometimes refuse to allow the extension to be built.

It is your responsibility to ensure that you apply correctly to us, clearly stating the notification is under this scheme and provide all the necessary information that the law requires. If you fail to provide all the information you will not be able to go ahead.

You cannot start to build until you receive written notification from us either that prior approval is not required; prior approval is required and given; or until the expiry of not less than 42 days after the date on which we received the information and we have not sent you written notification as to whether we have given or refused prior approval.

To benefit from these permitted development rights, the extension must be completed on or before 30 May 2016. The developer must notify us in writing of the completion date.

You cannot use this procedure if your property is in a conservation area. You will also need to ensure that all parts of Class A Part 1, Schedule 2 of the Town and Country Planning (General Permitted Development) Order 1995 apply.
